Terms and conditions

The website Mobility Mallorca renting of orthopaedic articles and cars in Mallorca (hereinafter, the ‘Website’) is the property of the company ADE ELEVATION S.L.U.

ADE ELEVATION S.L.U guarantees the protection of all personal data provided by the User on the Website and, in compliance with the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data, in Royal Decree 1720/2007 of 21 December and other applicable regulations, informs you that:

  1. a) All personal data provided through the Website will be included in the ‘Clients’ files, all of which are created and maintained under the responsibility of ADE ELEVATION S.L.U, duly protected and registered with the Spanish Data Protection Agency.
  2. b) Your personal data is collected for the following purposes:

– To manage requests for the rental of scooters for reduced mobility, home accessories, mobility materials such as wheelchairs, orthopaedic items, hospital beds, transfer cranes, stairlifts and everything related to orthopaedics.

– To process payments through the Online Shop of the Website itself.

– To send interested parties the newsletter with current news and offers related to the services provided.

– To provide information to users about the products and services marketed by the company.

– To receive the Curriculum Vitae of the applicants in order to manage the ADE ELEVATION S.L.U. employment exchange.

– Resolve complaints or queries through the channels provided for this purpose: Contact Form, Online Chat, email and customer service telephone number.

– Provide users with commercial information about offers and promotions launched by ADE ELEVATION S.L.U, which may be of interest to them.

  1. c) In the collection and processing of personal data, adequate security measures have been adopted to prevent loss, unauthorised access or manipulation of the same, in accordance with the provisions of Royal Decree 1720/2007 of 21 December.
  2. d) ADE ELEVATION S.L. undertakes to protect the confidential information to which it has access, implementing the technical and organisational security measures established by the data protection regulations, depending on the type of data processed in each case.
  3. e) Under no circumstances will ADE ELEVATION S.L.U. use the personal data that the User/Client makes available to provide services other than those referred to in section b) of this document or, where appropriate, to achieve a utility of its own or other than that authorised by the owner of said data.
  4. f) The user is informed and consents to the fact that for the provision of certain services (booking tickets, tickets, excursions, guided tours), and only in those cases where strictly necessary, your personal information may be transferred to third party partners of ADE ELEVATION S.L.U, located both in Spain and in other countries, which is known and consented to through the reading and acceptance of these General Conditions. This transfer of data will be carried out in strict compliance with the provisions of current legislation on Data Protection. As soon as the transfer takes place, these companies will become Responsible for the Processing of your data, and therefore any claim will have to be addressed directly to them.
  5. g) Apart from the above, no other data transfers are foreseen, apart from those legally established by other legislations or competent public administrations.
  6. h) When the user decides to access our corporate social profiles, we inform you that ADE ELEVATION S.L.U. undertakes to keep the maximum reserve, confidentiality and secrecy about the private and personal information to which we may have access. The personal data, images, videos, contents and information of any kind of our ‘friends or followers’ will be treated in accordance with the legal principles established in terms of Privacy, Honour, Intimacy, Personal Data Protection, Information Security, Image Rights, Intellectual Property, Consumer and User Protection, and other applicable regulations in each case.
  7. i) The user certifies that he/she is over 14 years of age to access the services provided through this Website and that he/she therefore possesses the necessary legal capacity to give consent to the processing of his/her personal data, in accordance with the provisions of this Privacy Policy.
  8. j) The user may, at any time, exercise their rights of access, rectification, cancellation, opposition or revocation of the consent granted regarding the processing of their personal data, by sending a duly signed letter to ADE ELEVATION S.L. to our postal address indicated above, clearly stating their contact details, which must be accompanied by a photocopy of their DNI/NIF or document proving their identity or may be sent to the following email address: ade.elevation@gmail.com.
  9. k) The user authorises and consents to the processing of his/her personal data in the terms indicated above by ticking the acceptance box at the end of each data collection form available on the Website.

L/ The images on the Website are purely commercial and the company reserves the right to provide material similar to the image on the Website.

M/ Cancellations are refunded if they are cancelled within 48 hours, cancellations via telephone will not be accepted, the customer has a maximum of 48 hours by sending an email to our contact: ade.elevation@gmail.com.

After 48 hours no amount will be refunded, the vehicle cannot be used on dates other than those contracted.

Opening hours Monday to Friday from 09h30 to 19h00 Saturdays 10h to 19h and Sundays 10h30 to 13h00h Sundays only open in the summer months (May to October) out of business hours are not attended.

General rental conditions

  1. USE AND CONDITION OF THE EQUIPMENT AND VEHICLES FOR HIRE.
  2. 1 The client receives the vehicle or the equipment described on the contract page, in perfect working condition, clean and in good working order, tyres checked, chargers, batteries, the equipment is delivered in perfect condition, the user undertakes to keep them and use them or drive them with our vehicles for reduced mobility, electric wheelchair or any other device that appears on this website, the user undertakes to use the rented equipment as at the time of delivery in perfect condition, complying with the traffic regulations for reduced mobility devices, the user agrees by renting that it is forbidden to circulate on roads reserved for combustion vehicles . The signature of the rental contract implies the acceptance by the customer of the list of accessories present, the proper use and the description of the leased equipment. Any damage not marked or stipulated in writing in the contract at the beginning of the rental will be considered as new damage and will be imputable to the contract holder.
  • Not to repair the vehicle without prior authorisation from Ade Elevation SLU.
  • Not acknowledging or prejudging responsibility for the event.
  • Not to abandon the rented vehicle and to remain with it until the arrival of the towing service.
  • 1.2 The client confirms that he/she has received sufficient information on the use and verification of the condition of the equipment and has received instructions and instructions for proper use from our team at the time of delivery and that the hirer is solely responsible for the use of the rented equipment, the rental company is not liable for mishandling that could damage a patient during the rental period.

1.2 Any damage caused to the rented equipment shall be paid for by the client according to the damage, breakage, loss or replacement cost of each damaged, stolen or lost item. It is expressly forbidden to vary any technical characteristics of the equipment or to make any modification to its external and/or internal appearance.


1.3 The rental of combustion vehicles with platform access for wheelchair users is only authorised to be driven by the person identified and accepted by Ade Elevation S.L.U. in the rental contract or any annex to the same on condition that they have reached the age of 25 and will be given an annexed contract with all the conditions at the time of delivery, they will be required to have a credit card with a minimum deposit of 250€.

1.4 Punctures and damages caused during the stay are not covered.

1.5 It is not permitted under any circumstances to leave Mallorca on board any type of boat, train, lorry or plane with our vehicles.

1.6 It is forbidden to leave the territory of the island of Mallorca with the material or vehicle.

1.7 Any damage of any kind that Ade Elevation S.L.U. may suffer as a result of non-compliance with the conditions set out in this article and/or due to use other than that agreed by the Client, authorises Ade Elevation S.L.U. to withdraw the vehicle from the Client and to invoice and charge the Client for the duly justified amounts corresponding to the repair or other expenses arising from said damage.

1.8 In the event of theft or loss of the vehicle, the Client is obliged to present the keys of the vehicle and the corresponding theft report, they will be charged 50% of the purchase value of the stolen material or vehicle and must present the keys and the report to the office within a maximum period of 24 hours, otherwise the full amount of the vehicle will be charged.

  1. PRICE, DURATION, EXTENSION OF THE RENTAL.

2.1 The rental price is the price stated in the rental contract and is established according to the General Tariff in force (with regard to services, taxes and fees) and the initial price agreed with the Client at the time of rental, according to the rate selected on the website.

2.2 Cash deposits are not accepted, for deliveries to homes, airports, hotels, the deposit will only be processed by bank card and is automatically released with the duration issued by the bank itself, as long as Ade Elevation S.L.U. establishes that there is no concept to deduct from it for other concepts in accordance with the provisions of these General Conditions. After the correct return of the vehicle, Ade Elevation Slu cannot release the deposit; the issuing bank will be responsible for releasing the amount withheld.
2.4 The security deposit will be blocked depending on the equipment or vehicle rented and will be automatically released within approximately 2/3 weeks, depending on the conditions you have with your bank it may take several days longer. In case of damage, you will be charged for the amount of the damage caused and its subsequent installation.
2.5 Under no circumstances can the deposit paid at the beginning of the rental period be used to extend the rental period. In the event that the client wishes to keep the vehicle for a longer period than initially agreed, he/she undertakes to obtain prior express authorisation from Ade Elevation and to immediately pay the additional amount for the extension, otherwise he/she will not be able to charge by bank card for refusal or for any other reason, if he/she does not pay the extension, the vehicle must be returned or the authorities will be informed.

2.6 The client undertakes to return the vehicle to Ade Elevation S.L.U. on the scheduled date and time and at the Ade Elevation S.L.U. shop or at the place agreed in the rental contract. No refund will be made if the vehicle is returned before the deadline stipulated in the contract. The return of the vehicle in a different place from the one initially agreed, with the prior acceptance of Ade Elevation S.L.U. implies an additional charge of 50€. It is essential to present a copy of the contract and the keys of the vehicle for any change or return. A delay in returning the vehicle without prior notice to the Ade Elevation S.L.U. shop where it was rented in addition to the price of the extra days of rental.

2.7 The service is only considered to be completed once the vehicle and the vehicle keys have been handed over to the Ade Elevation S.L.U. rental shop and under the conditions stipulated in the contract.

  1. PAYMENTS

3.1 The Client undertakes to pay Ade Elevation S.L.U :

  1. a) The amount resulting from the application of the General Tariff in force and the initial price agreed in the rental contract according to the selected tariff, corresponding to the duration, equipment and complementary services such as delivery and return, according to the stipulated conditions, as well as the applicable taxes and fees.
  2. b) The amount corresponding to the fines or penalties corresponding to any infringement of the legislation in force, which may be incurred by the Client derived from the use of the vehicle object of the rental contract, as well as the corresponding surcharges for the delay in payment by the Client and the judicial or extrajudicial expenses in which Ade Elevation S.L. may have incurred as a result of the above. In the event of a fine, the client will be charged €30 for the corresponding administrative procedures, which will be charged directly to the client’s credit card.
    c) The amount of 50€ if an employee of Ade Elevation S.L.U. has to go to a municipal depot to recover the vehicle that was removed due to the Client’s responsibility. Likewise, he/she will also be responsible for the payment of the fine imposed by the local authorities, which will be charged directly to the customer’s credit card.
    d) The amount that could be derived from any circumstance causing damage to third parties or to Ade Elevation S.L.U. In the event that the Client is insured, when Ade Elevation S.L.U. receives from the insurer the amount of the loss or damage, it will return to the Client the amount charged for this concept.
  3. payment use and conditions

3.2 Payment of the amounts outlined in 3.1 above must be made in cash or by Visa MasterCard. Additional amounts may be charged directly from the deposit, Ade Elevation will charge the excess to the client’s credit card account. If the client does not pay within 24h. Ade Elevation S.L.U. will be able to deduct this payment from the deposit and claim them by judicial or extrajudicial means without further procedure. The client authorises this operation by signing this contract.

3.4 The electric scooters for the elderly must comply with the regulations in force regarding road safety. The user/client is solely responsible for not complying with the regulations for the use of devices for people with reduced mobility and for any accident, fortuitous, provoked or accidental fall, damage to third parties or urban furniture.

3.5 Punctures in scooters with reduced mobility are exempt from roadside assistance and the replacement of the tube and tyre will be charged, the user must call a taxi adapted to return to their accommodation and call the company on the phone number that appears in the contract or on the distinctive stickers on the same leased device, when we can go to the hotel or accommodation to proceed to change the tyre for a payment of 50 € to be paid by the customer to the leasing company ADE Elevation SLU.

3.6 In case of sending a vehicle we will charge 50€ in Palma city and maximum 10kms out of this distance the amount will be charged 90€ as a rescue fee apart from the replacement not included.

  1. 4. THEFT, LOSS AND DAMAGE (bicycles, scooters, electric scooters, various materials…)

4.1 The rental price does not include insurance for theft, loss, total or partial breakage, damage (or any other damage) suffered and you will have to pay for the replacement or repair.

  1. ASSISTANCE FOR CAR HIRE

5.1 In the event that the vehicle can no longer be driven or cannot be started, the Client must call the rental company Ade Elevation S.L.U +34 697 402 352.

5.2 The agreed roadside assistance service is not included in the rental price and covers a distance of up to 10 km from the shop where the vehicle was rented at a rate of 50 €, for assistance outside this radius the cost will be 90 €. The user under no circumstances accepts to leave the vehicle on the public road and in case of theft will be responsible for the total cost of replacement.
5.4 There is no possibility of replacement vehicle and the customer must wait for its repair in case of exceeding 24h, may request another replacement device and if it were for damage caused during the stay by the user or third parties will not proceed to any replacement until full payment of the damage or theft of the same.
5.5 In case of breakdowns, accidents, punctures the client will not be able to extend the rental, we will not offer any extra hour/day for having waited for the assistance service if needed, the reimbursement of taxis or other elements that the client would have used to return to their facilities, place of residence or in our facilities are totally excluded.
5.8 In the event of loss, breakage or theft of your belongings including on the premises of one of our establishments the company, or inside one of our vehicles is not responsible or proceed to any reimbursement, the customer is solely responsible for their belongings.

  1. MAINTENANCE AND REPAIRS

6.1 The Client is not authorised to order the repair of the vehicle, unless expressly authorised by Ade Elevation S.L.U. and having received written confirmation from our company.

6.2 It is the obligation of the client to stop the vehicle, orthopaedic equipment of our company when any malfunction is detected, otherwise the client shall be responsible for the repairs. The client must contact Ade Elevation.

6.3.1 The client is not entitled to a replacement vehicle for the duration of the mechanical overhaul or repair.

  1. CARS: ACCIDENTS, MAINTENANCE AND REPAIRS.

8.1 In the event of causing or having an accident, damage to third parties or public or private furniture, the user must present his/her identity document and cover the costs by his/her own means and the user shall be solely responsible for any damage caused to property or persons with his/her own travel insurance or civil liability insurance.

8.4 It is formally forbidden to repair, carry out maintenance on your own or take our vehicles to another workshop, for any repairs, breakdowns or maintenance we are the only ones authorised to repair our material located at Calle Manacor 123, 07007 Palma de mallorca, the address appears on the rental contract itself.

  1. AMENDMENTS TO THE RENTAL AGREEMENT.

9.1 These general terms and conditions, as well as the remaining clauses of the rental agreement, may only be modified by written agreement signed by both parties.

  1. COMPUTER PROCESSING OF PERSONAL DATA

10.1 The client authorises the automated processing of the personal data collected in this contract, which is necessary for the presentation of the agreed service, as well as for the offer and contracting of other products and other services of Ade Elevation. The Client is informed of the right to access, rectify and, if necessary, cancel their personal data by email ade.elevation@gmail.com. The Client also gives their consent for Ade Elevation to transfer their data to companies of the group, its franchisees or others with which Ade Elevation concludes collaboration agreements for the better provision of the vehicle rental service, based in Spain, respecting Spanish legislation on the protection of personal data.

  1. APPLICABLE LEGISLATION AND JURISDICTION.

11.1 This contract shall be governed by and construed in accordance with the laws of Spain.

11.2 Any questions arising from this contract between Ade Elevation and the Client shall be subject to the jurisdiction of the Spanish courts and tribunals corresponding to the city where the contract was signed, to which both parties submit.

11.3 Mobility Mallorca is the trade name used by ADE Elevation S.L.U. with CIF B 57654667 to promote its activity in the rental of materials, vehicles or others on the website.

11.4 The company hereinafter referred to as ADE Elevation SLU trade name Mobility Mallorca is not liable for any damage in the event of return, damage or theft.

11.5 The client is responsible for both the rented equipment and their belongings and must respond in case of theft, loss or loss of rented equipment by paying the value of the material.

  1. DELIVERY SERVICE TO THE AIRPORT OF RENTED EQUIPMENT

12.1 The delivery service for materials such as car seats, or others with deliveries at the airport is carried out from our office at Calle Manacor 123, 07007 Palma de Mallorca. No reimbursement will be made for late delivery by our delivery service.

  1. Deposit and fines

13.1 The client must pay a deposit according to the value of the rented material. Without this, the client will not be able to proceed with the booking, whether or not the reservation has been paid. The booking will not be refunded if the client objects to the payment of the deposit.

13.2 The deposit is paid by debit/credit card, not in cash. If there is any kind of damage, the amount will be charged and if it exceeds the amount of the deposit, it will be charged directly from the bank card provided to us by the client.

13.3 Bank card deposits are referred to as pre-authorisation, whereby the amount of the deposit is blocked. The amount is retained and is automatically unblocked and the bank is in charge of unblocking it within the time stipulated in article 13.5.

13.5 Duration of the blocking approximately 2 weeks for a Spanish bank, if your bank is located abroad it may take longer.

13.5 Return of the deposit, the deposits are made by bank card as it is a pre-authorisation and as it is only a retention in your account, the amount is automatically unblocked by the banking system. ADE ELEVATION SLU does not unblock the pre-authorisation operations and the bank itself is responsible for carrying out this procedure.

  1. booking cancellation policy

14.1 If the cancellation is made with a notice of more than 48 hours, 100% of the amount paid on the reservation will be refunded and sent only by email: ade.elevation@gmail.com phone calls, SMS, WhatsApp will not be accepted.

14.2 No cancellations will be accepted for notice of less than 48 hours.

14.3 If the cancellation of the booking is made without notice no refund will be made.

14.4 Ade Elevation S.L. is not responsible for weather conditions and no refunds will be given even if partial due to bad weather or other weather conditions.

14.5 We do not guarantee the delivery of materials to airport hotels unless bookings are made at least 48 hours in advance of arrival dates and times.

15 Reasons for cancellation of the car hire on the spot

15.1 Ade Elevation reserves the right to cancel the booking on the spot if the client is not in a fit state to drive or his behaviour presents a danger to others or to himself. If he is aggressive towards our staff such as insults, coercion, verbal or physical aggression, or if he is under the influence of substances that are not suitable for driving, these will be sufficient grounds to cancel the booking even if it has been paid for and booked, there will be no refund of the rental or delivery service.

15.2 Ade Elevation SL reserves the right not to rent to those clients who violate any of the conditions or obligations established in this document.

Likewise, Ade Elevation SLU reserves the right not to hire the vehicle or equipment in the event of justified doubts about the possibility of non-compliance with the obligations of this contract, due to a history of non-payment or incidents on the part of the client.

16 Early return

16.1 In the event of early return of the rented vehicle or equipment, Ade Elevation S.L.U. with the trade name Mobility Mallorca will not apply any penalty to the contract holder. Likewise, Ade Elevation S.L.U. will not reimburse for unused days, nor will it reimburse any extras contracted for unused days.

17 Delivery of the vehicle to the airport/hotels without presence.

17.1 Deliveries to hotels, full payment or the balance is required at the time of delivery.

18 GPS Location

18.1 Some of our vehicles are equipped with a GPS tracking system, Air tag or other fleet control devices.

18.2 The GPS tracker collects only information about the movement and location of the vehicle.

18.3 It is strictly forbidden to disconnect the GPS tracker as a means of locating vehicles to prevent theft and for no other purpose.

18.4 In case of unplugging or disconnecting the GPS tracker you will be charged a replacement fee of 70€.

19.UNAUTHORISED USE OF THE VEHICLE

19.1 Renter shall be obliged to use the vehicle with due diligence and care, in accordance with its characteristics, respecting the current traffic regulations for vehicles for people with reduced mobility, in any case, any situation that could cause damage to the vehicle or to third parties. Likewise, in any case of non-compliance with the provisions of this point, it shall be understood that unauthorised use has been made. Renter is obliged not to allow the vehicle to be driven by any person other than those authorised in accordance with this contract and must pay the charge for unauthorised use of the vehicle, with Renter being directly responsible for any damage or harm caused to the vehicle or third parties in such a case. The Hirer shall be fully liable for any damage caused to interior and exterior parts of the vehicle due to unauthorised use of the vehicle. In case of unauthorised use of the vehicle, Renter is obliged to pay all expenses arising from such damage, the specified amount to be charged to Renter’s credit card, with Renter’s express agreement to all effects. The Lessee’s signature on the Contract shall be deemed to be acceptance of the general and particular conditions specified in the contract.

Unauthorised use includes, but is not limited to, the following examples:

– Participation in competitions. – Illegal racing. – Driving without a driving licence or permit, or without the Lessor’s authorisation. – Transfer of the vehicle to a third party – Driving in places that are not suitable for vehicles for people with reduced mobility, such as beaches, motorways for cars, etc. – Driving on roads that could lead to damage to the vehicle’s underbody/crankcase. – Negligent behaviour in the event of warning lights or warning signs on the vehicle’s dashboard that the lessee declares to be aware of when signing this contract. – The transport of goods or animals in the vehicle. – The transport of furniture, except for vehicles designed for this purpose. – The transport of persons or goods that directly or indirectly implies a payment to the Hirer (e.g. using the vehicle as an illegal ‘something’). – The subletting of the vehicle. – Transporting a number of persons or amount of luggage greater than that authorised for the reduced mobility vehicle – Transporting two persons as this is not authorised in the case of a single seat, for which the double seat scooter must be rented – Driving the vehicle in a state of fatigue, illness or under the influence of alcohol, medication or drugs. – Reckless driving. – Driving contrary to the rules for this type of PRM vehicle – Driving the rented vehicle by an unauthorised person – Taking the vehicle outside Mallorca is not permitted – Use of the vehicle after the end of the rental period – Use of the vehicle after the end of the rental period.
